The fair-play rules.

DailyTekk is free to use and made in good faith. These terms explain what you can expect from us and what we ask of you.

The short version

  • Enjoy the games and tools, free, for your own personal use.
  • Be decent: don't attack, overload, scrape or misuse the site.
  • What you write in Your Desk is yours, and it's private.
  • DailyTekk's art, code, music and names belong to DailyTekk or its licensors.
  • Everything is provided as is. Keep your own backups of anything important.

1Accepting these terms

These terms apply to dailytekk.com and everything on it, including the Hey it's Chris game and Tekk Town, the other games, Your Desk, Daily Grind FM and the contact form (together, "the site"). The site is run by Chris, the creator behind DailyTekk ("DailyTekk", "we", "us"). By using the site, you agree to these terms and to our privacy policy. If you don't agree, please don't use the site.

If you're under the age of majority where you live, please use the site with the involvement of a parent or guardian.

2Using the site, games and tools

We give you a personal, non-exclusive, non-transferable and revocable permission to use the site for your own non-commercial purposes. There are no accounts and nothing to pay. You can use Your Desk for work, study or anything else you like; what's personal is your use of the tool, not the subject of your notes.

Games, tools and features may change, be paused or be retired at any time, sometimes without notice. Game scores, unlocks and items have no monetary value and can't be exchanged for anything.

3Acceptable use

Please don't:

  • break the law, or use the site to harm, harass or deceive anyone;
  • try to break into, disrupt, overload or probe the site, its servers or other people's synced data, or get around its rate limits and security;
  • send spam, malware or abusive messages through the contact form;
  • scrape, copy or mirror the site in bulk, or use automated tools against it beyond normal search engine indexing;
  • reuse DailyTekk's art, music, code or names in a way these terms don't allow, or pretend to be DailyTekk or Chris.

Found a security problem? Thank you. Please report it privately through the contact form rather than testing it on other people's data.

4Your content

What you create stays yours. Your tasks, notes, habits, voice notes and anything else you put in Your Desk belong to you. They're saved on your device and, only if you turn on sync, stored end-to-end encrypted so we can't read them. We claim no rights over them.

When you send us a message, idea or bug report, you keep ownership of it. You allow us to use it to reply and, if you share an idea or feedback, to use that idea to improve DailyTekk without owing you anything for it. We won't publish your name or message without asking you first.

5Our content and names

The site's design, code, pixel art, characters, writing, sound design and original music, and the names DailyTekk, Hey it's Chris, Tekk Town, Your Desk and Daily Grind FM, belong to DailyTekk or are used with permission. Using the site doesn't give you any ownership of them. You're welcome to share links, screenshots and short clips of the site for commentary, reviews and fun, as long as you don't suggest DailyTekk endorses you.

Some music and recordings are by other people and are used under open licences: CC0 (public domain) today, and Creative Commons Attribution (CC BY) wherever a credit says so. You'll find who made what, and under which licence, in Daily Grind FM's About the sounds panel, with full lists of track credits and recording credits. Those works stay under their own licences.

Product names, logos and trademarks of other companies that appear in videos or on the site belong to their owners and are used only to identify those products.

7Sponsors and affiliate links

DailyTekk may work with brands and may use affiliate links in the future. If a link earns us a commission, or a feature or video is sponsored, we'll say so clearly near it. It never costs you extra, and it doesn't change what we think of a product.

8Provided as is

We work hard to make DailyTekk reliable, but the site, games and tools are provided "as is" and "as available", without warranties of any kind, express or implied, including fitness for a particular purpose, accuracy and non-infringement. We don't promise the site will always be available, error-free or secure.

Your Desk is not a backup service. Your desk lives in your browser, which can clear it (for example if you clear site data, use private browsing or run low on space). Sync copies your desk between devices; it isn't an archive. Use the desk's backup option and keep your own copy of anything important.

9Limitation of liability

To the fullest extent the law allows, DailyTekk and Chris won't be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of data, profits, revenue or goodwill, arising from your use of (or inability to use) the site, even if we were told such loss was possible.

Because the site is free, our total liability for any claim relating to the site is limited to 50 US dollars. Some places don't allow certain limits on liability, so some of this may not apply to you. Nothing in these terms limits liability that can't be limited by law, or your rights as a consumer that can't be waived.

10Indemnity

If you misuse the site or break these terms and that leads to a claim against DailyTekk or Chris, you agree to cover the reasonable costs of that claim, including legal fees, to the extent the law allows.

11Suspension and termination

You can stop using the site at any time. We may limit or block access for anyone who breaks these terms or puts the site or other people at risk, and we may change or shut down any part of the site. If we retire a tool you rely on, we'll try to give you a reasonable way to keep your data, but please keep your own backups. The sections that by their nature should survive (such as ownership, provided as is, liability and governing law) still apply after you stop.

12Changes

We may update these terms as the site grows. When we do, we'll change the effective date at the top, and say so on this page if the change is significant. If you keep using the site after an update, you accept the new terms.

13Governing law

These terms are governed by the laws of the jurisdiction in which DailyTekk's operator resides, without regard to conflict-of-law rules. Any dispute will be handled by the courts of that jurisdiction, unless the law where you live gives you the right to bring it in your local courts. Before going that far, please contact us: most things can be sorted out with a friendly message.

14The legal bits

These terms and the privacy policy are the whole agreement between you and DailyTekk about the site. If any part turns out to be unenforceable, the rest still applies. If we don't enforce something straight away, we haven't given up the right to do so later. You can't transfer your rights under these terms; we may transfer ours if DailyTekk changes hands, in which case these terms continue to protect you.
